There is a war on women being waged by the federal government. But it’s not the one of which you’re thinking.
A new piece of bipartisan legislation is in the Senate Committee on Health, Education, Labor, and Pensions (HELP) known as the Personal Care Products Safety Act (S. 1014). The labeling regulations in this bill already exist elsewhere and are not new. However, the fees they create are.
It creates a fee for each individual product a person sells. For example, if you sell soap, and you have 30 different fragrances, you will have to pay 30 separate fees every year. You want to offer bath bombs in 25 fun colors and scents, no problem! But, you’re going to pay 25 fun fees first.
Its the same with medicinal herbal products. The FDA now classifies herbal products as supplements, which places herbal products under a much different level of scrutiny. Such natural home remedies, like elderberry or echinacea tinctures, can only be made by companies large enough to buy their way through the extensive through the extensive hoop system known as the GMP, or Good Manufacturing Practices. The GMPs for supplements are different and much more restrictive than those for food.

A few years ago, the FDA classified reusable cloth menstrual pads as medical devices. This requires a hefty fee be paid to the government. And, under the new Obamacare legislation, a special medical device tax. There are plenty of wonderful, skilled herbalists and soap makers who are men. However, the majority of the small businesses I see selling herbal remedies, herbal soaps, herbal lotions and other herbal or natural products on Etsy, at farmer’s markets and in other local community market opportunities, are made by women. I don’t know of a single cloth pad company where there is a man at home sewing reusable cloth pads.
The war on cottage industry and small business is the real war on women. This war is on women who have to fit in their business around their kids, husband, and often aging parents. The money from selling soap at a craft fair or from selling artisinal cheese from one’s homestead, may be mean the difference between a family paying their heating bill or maybe the property taxes. And this war is being waged by both republicans and democrats alike.
